Terms and Conditions

Welcome to Complete Driving Experience LLC ("CDX," "Company," "we," "us," or "our"). These Terms of Service and Purchase Agreement ("Agreement" or "Terms") constitute a legally binding contract between you ("Student," "Customer," "you," or "your") and Complete Driving Experience LLC, a Washington State limited liability company.

By enrolling in any course, purchasing any service, scheduling any appointment, or otherwise engaging with Complete Driving Experience LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you are under 18 years of age, your parent or legal guardian must review and accept these Terms on your behalf and assumes full responsibility for your compliance.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PURCHASE OUR SERVICES OR ENROLL IN OUR PROGRAMS.

Your electronic acceptance, signature, payment, or participation in any CDX service constitutes your binding agreement to these Terms.

2. COMPANY INFORMATION

Tacoma Armory Building – Entry Instructions (When Applicable): Please arrive a few minutes early. Use the black call box/buzz-in system at the side entrances to the Tacoma Armory and enter 6019-OPEN. If you wait in the wrong area and miss your appointment window, late/no-show rules and fees may apply.

Complete Driving Experience LLC is a licensed driving school in the State of Washington providing driver education courses, behind-the-wheel training, knowledge examinations, and skills testing services.

3. SERVICES OFFERED

Complete Driving Experience LLC offers the following services, which may be modified at any time at our sole discretion:

  • Driver Education Courses (Online and In-Person)
  • Behind-the-Wheel (BTW) Training Lessons
  • Knowledge/Written Examinations
  • Skills/Drive Testing
  • Parent Seminars and Webinars
  • Consultations
  • Specialized Training for Neurodivergent Students
  • Accommodated Instruction for Students with Disabilities, Anxiety, ADHD, Autism, and Learning Differences

All services are subject to availability, scheduling, and compliance with Washington State Department of Licensing (DOL) regulations.

4. ENROLLMENT AND ELIGIBILITY

4.1 Eligibility Requirements

Students must meet all Washington State requirements for driver education and licensing, including but not limited to:

  • Minimum age requirements as mandated by Washington State law
  • Valid identification documentation
  • Completion of required prerequisite courses or hours (where applicable)
  • Physical and mental capability to safely operate a motor vehicle
  • Valid learner's permit (for behind-the-wheel training and skills testing)

4.2 Accurate Information

You agree to provide accurate, current, and complete information during enrollment. Providing false, misleading, or fraudulent information is grounds for immediate termination of services without refund.

4.3 Medical and Accommodation Disclosure

Students requiring accommodations must disclose relevant information during enrollment or consultation. While CDX specializes in accommodating students with disabilities, ADHD, autism, anxiety, and learning differences, we reserve the right to determine whether we can safely and appropriately provide services based on individual circumstances.

5. PAYMENT TERMS

5.1 Payment Due at Time of Purchase

Full payment is due at the time of enrollment or service purchase unless a written payment arrangement has been approved by CDX management. Payment arrangements, if offered, are at the sole discretion of CDX and subject to additional terms.

5.2 Accepted Payment Methods

CDX accepts payment via credit card, debit card, checks, vouchers and other methods as needed. All payments are processed securely through our authorized payment processors.

5.3 Payment Arrangement Default

If you have been granted a payment arrangement and fail to make payments as agreed:

  • A late fee of $25.00 will be assessed for each missed or late payment
  • Services will be immediately suspended until the account is brought current
  • Continued default may result in termination of services without refund
  • Outstanding balances may be sent to collections, and you will be responsible for all collection costs, attorney fees, and court costs

5.4 Returned Payments and Chargebacks

  • A $35.00 fee will be assessed for any returned check or declined payment
  • Unauthorized chargebacks or payment disputes are considered a breach of this Agreement
  • You agree to pay all costs associated with recovering disputed amounts, including attorney fees and collection costs
  • CDX reserves the right to pursue legal action for fraudulent chargebacks

6. NO REFUND POLICY

6.1 ALL SALES ARE FINAL

COMPLETE DRIVING EXPERIENCE LLC MAINTAINS A STRICT NO-REFUND POLICY. ALL PURCHASES ARE FINAL AND NON-REFUNDABLE.

By purchasing any service from CDX, you acknowledge and agree that:

  • No refunds will be issued for any reason, including but not limited to: change of mind, scheduling conflicts, relocation, dissatisfaction, failure to pass examinations, failure to complete courses, or student misconduct
  • No refunds will be issued for unused portions of purchased services
  • No refunds will be issued if services are terminated due to student violation of these Terms
  • No refunds will be issued for missed appointments or no-shows
  • No refunds will be issued if a student is unable to complete training due to suspension, revocation, or denial of driving privileges by the DOL or any government agency

6.2 Service Credits

In limited circumstances and at CDX's sole discretion, service credits (not cash refunds) may be issued for documented emergencies. Service credits are non-transferable and expire 90 days from issuance.

6.3 Acknowledgment

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU HAVE READ AND UNDERSTAND THIS NO-REFUND POLICY AND WAIVE ANY RIGHT TO DISPUTE OR SEEK REFUND OF ANY PAYMENT MADE TO CDX.

7. CANCELLATION, RESCHEDULING, AND LATE/NO-SHOW POLICY

7.1 Student Cancellations and Rescheduling (All Services)

All cancellations and rescheduling is the sole responsibility of the student/parent. CDX and it's staff are not responsible for managing your appointment or reminders.

7.2 Grace Periods (Show-Up Window)

We try to be flexible, but we also have tight schedules and state requirements. The following grace periods apply:

  • Knowledge exams and in-person class sessions: 5-minute grace period. If you arrive more than 5 minutes late, you may be required to reschedule and applicable fees may apply. NO REFUNDS.
  • Behind-the-wheel lessons (BTW): 10-minute grace period. If you arrive more than 10 minutes late, the lesson will be treated as a late cancellation/no-show (at CDX’s discretion), and applicable fees may apply ($50).

7.3 Repeated Cancellations

Students who cancel or reschedule more than three (3) times may be subject to:

  • Mandatory prepayment for future appointments
  • Termination of services without refund
  • Prohibition from future enrollment

7.4 CDX Cancellations

CDX reserves the right to cancel or reschedule appointments due to:

  • Instructor illness or emergency
  • Inclement weather or unsafe driving conditions
  • Vehicle maintenance or mechanical issues
  • Other circumstances beyond our reasonable control

In such cases, CDX will make reasonable efforts to reschedule at a mutually convenient time at no additional charge.

8. STUDENT RESPONSIBILITIES AND CODE OF CONDUCT

8.1 Student Obligations

By enrolling in CDX services, you agree to:

  • Arrive on time for all scheduled appointments
  • Possess valid identification and learner's permit (as applicable) at each appointment
  • If you arrive without a valid ID and/or permit when required, you will be charged a $50.00 fee and your appointment may be treated as a late cancellation/no-show (meaning the session may be forfeited), at CDX’s discretion
  • Be sober and drug-free; not under the influence of alcohol, cannabis, or any impairing substance
  • Follow all instructions from CDX instructors
  • Treat all CDX staff, instructors, and other students with respect
  • Maintain appropriate hygiene and dress appropriately
  • Not use mobile phones or electronic devices during instruction unless permitted
  • Complete all required coursework and assignments on time
  • Comply with all applicable traffic laws during training

8.2 Prohibited Conduct

The following conduct is strictly prohibited and will result in immediate termination of services without refund:

  • Verbal or physical abuse toward any CDX staff, instructor, or student
  • Harassment, threats, or intimidation of any kind
  • Discrimination based on race, gender, religion, disability, or any protected class
  • Attendance while impaired by drugs or alcohol
  • Providing false information or fraudulent documents
  • Cheating on examinations
  • Damage to CDX vehicles or property
  • Possession of weapons on CDX premises or in CDX vehicles
  • Refusal to follow instructor safety directives
  • Any illegal activity

8.3 Termination for Cause

CDX reserves the right to immediately terminate services for any violation of this Code of Conduct. No refund will be issued for services terminated due to student misconduct.

9. EXAMINATION AND TESTING POLICIES

9.1 Exam Requirements (Applies to All Exams)

  • All exams are electronic and must be taken on the Student’s personal device (phone, laptop, or tablet). CDX does not guarantee availability of loaner devices.
  • The Student must have (and be able to access) a valid Washington State License Express account, as required for testing and reporting.

9.2 Knowledge Examinations

  • Students must achieve a passing score as determined by Washington State DOL requirements, 32 correct out of 40-80% minimum score to pass.
  • Knowledge exam fee: $45.00
  • Failed examinations may be retaken subject to applicable waiting periods and re-test fees of $45.00 per attempt
  • Cheating or attempted cheating will result in immediate failure and possible termination of services

9.3 Skills Testing

  • Students must demonstrate competency as required by Washington State DOL standards
  • Skills test fee: $85.00
  • Failed skills tests may be retaken subject to applicable waiting periods and re-test fees of $85.00 per attempt
  • The examiner's decision is final
  • CDX is not responsible for students who fail to pass DOL examinations

9.4 Bundled Exam Pricing

  • Knowledge + Skills (bundle) fee: $125.00 (when purchased together)
  • Bundle pricing does not change CDX’s no-refund policy and does not waive any late/no-show or rescheduling fees.

9.5 Arrival and Grace Periods for Exams

State processes and scheduling windows are strict. For knowledge exams and skills tests, a 5-minute grace period applies. If you arrive more than 5 minutes late, you may be required to reschedule and applicable no-show/late cancellation fees may apply.

9.6 No Guarantee of Passage

CDX DOES NOT GUARANTEE THAT ANY STUDENT WILL PASS ANY EXAMINATION OR OBTAIN A DRIVER'S LICENSE. Successful completion of our training programs does not guarantee licensing by the Washington State Department of Licensing.

10. ASSUMPTION OF RISK AND LIABILITY WAIVER

10.1 Inherent Risks

You acknowledge that learning to drive and operating a motor vehicle involves inherent risks, including but not limited to:

  • Traffic accidents and collisions
  • Personal injury or death
  • Property damage
  • Injury to third parties
  • Psychological stress or anxiety

You voluntarily assume all risks associated with driver education and training.

10.2 Release and Waiver of Liability (Broad Release)

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Complete Driving Experience LLC, its owners, members, managers, officers, employees, instructors, examiners, agents, and affiliates (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by you or any third party, or to any property belonging to you, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, while participating in any CDX program, training, examination, observation, or related activity.

This release includes (without limitation) claims arising from:

  • Instruction, supervision, or examination decisions
  • The condition, maintenance, or use of any training or testing vehicle
  • Road, traffic, weather, and third-party driver conditions
  • Acts or omissions of other students or third parties

10.3 Release of Claims by Parent/Guardian (Minors)

If the Student is under 18, the parent/legal guardian agrees to the release and waiver in this Section on behalf of themselves and the minor Student, and agrees to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the minor Student, to the fullest extent permitted by law.

10.4 Limitation of Liability

IN NO EVENT SHALL CDX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of income, loss of employment opportunities, emotional distress, or any other damages arising from your participation in CDX services, EVEN IF CDX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CDX'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO CDX FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

10.5 Vehicle Damage

If damage to a CDX training vehicle occurs during your instruction, testing, or participation in CDX services due to your negligence, recklessness, or intentional conduct, you agree to be financially responsible for all repair costs, insurance deductibles, diminished value (if applicable), towing/storage, administrative costs, and any other associated expenses.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Complete Driving Experience LLC and its Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to:

  • Your breach of these Terms
  • Your violation of any law or regulation
  • Your negligence or willful misconduct
  • Any claim by a third party arising from your actions during CDX training or services
  • Any dispute between you and any third party

12. DISPUTE RESOLUTION

12.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact CDX at (253) 387-7733 to attempt to resolve any dispute informally. Many concerns can be resolved quickly through direct communication.

12.2 Mandatory Binding Arbitration

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF CDX SERVICES SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION, administered by a mutually agreed-upon arbitrator in Pierce County, Washington, in accordance with Washington State arbitration laws.

YOU UNDERSTAND THAT BY AGREEING TO ARBITRATION, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

12.3 Waiver of Class Action

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to bring claims as a plaintiff or class member in any class, collective, or representative action.

12.4 Limitation on Claims

Any claim or cause of action arising from these Terms or your use of CDX services must be filed within one (1) year after such claim arose, or be forever barred.

12.5 Exceptions

Notwithstanding the foregoing, CDX reserves the right to seek injunctive relief or other equitable remedies in any court of competent jurisdiction.

13. COMPLAINTS AND REGULATORY MATTERS

13.1 Internal Complaint Process

If you have a complaint regarding CDX services, you must first submit your complaint in writing to CDX management. CDX will review and respond to complaints within a reasonable timeframe.

13.2 Regulatory Acknowledgment

You acknowledge that CDX operates under the jurisdiction of the Washington State Department of Licensing and complies with all applicable laws and regulations. By agreeing to these Terms, you agree to exhaust all internal complaint procedures with CDX before filing any complaint with the Department of Licensing or any other regulatory agency.

13.3 Waiver of Frivolous Claims

You agree not to file any false, misleading, or frivolous complaints against CDX with any regulatory agency. You acknowledge that doing so may constitute a breach of this Agreement and may subject you to legal action for defamation, tortious interference, or other applicable claims.

14. INTELLECTUAL PROPERTY

All course materials, curricula, instructional content, trademarks, logos, and other intellectual property provided by CDX are the exclusive property of Complete Driving Experience LLC. You may not copy, reproduce, distribute, or create derivative works from any CDX materials without express written permission.

15. PRIVACY AND DATA USE

CDX collects and uses personal information in accordance with applicable privacy laws. By enrolling in CDX services, you consent to the collection, storage, and use of your information for purposes including:

  • Service delivery and communication
  • Scheduling and appointment management
  • Compliance with DOL record-keeping requirements
  • Marketing communications (you may opt out at any time)
  • Quality improvement and training purposes

CDX will not sell your personal information to third parties.

16. PHOTOGRAPHS AND MEDIA RELEASE

By enrolling in CDX services, you grant CDX permission to use photographs, video recordings, or testimonials featuring you for marketing, promotional, and educational purposes, unless you provide written notice opting out.

17. MODIFICATIONS TO TERMS

CDX reserves the right to modify these Terms at any time. Updated Terms will be posted on our website and/or provided at the time of service. Your continued use of CDX services after any modification constitutes acceptance of the revised Terms.

18. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. ENTIRE AGREEMENT

These Terms, together with any enrollment forms, payment agreements, or other documents incorporated by reference, constitute the entire agreement between you and CDX regarding the subject matter hereof and supersede all prior agreements, representations, and understandings.

20. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Pierce County, Washington, and you consent to the personal jurisdiction of such courts.

21. NO WAIVER

The failure of CDX to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of CDX.

23. ACKNOWLEDGMENT AND AGREEMENT

BY PURCHASING SERVICES, ENROLLING IN A COURSE, OR PARTICIPATING IN ANY CDX PROGRAM, YOU ACKNOWLEDGE THAT:

  1. You have read and understand these Terms of Service and Purchase Agreement in their entirety.
  2. You agree to be legally bound by all provisions contained herein.
  3. You understand and accept the NO REFUND POLICY.
  4. You understand and accept all FEES AND PENALTIES described herein.
  5. You voluntarily ASSUME ALL RISKS associated with driver education and training.
  6. You WAIVE AND RELEASE CDX from liability as described herein.
  7. You agree to BINDING ARBITRATION and WAIVE YOUR RIGHT TO A JURY TRIAL AND CLASS ACTION.
  8. If you are a parent or guardian enrolling a minor, you accept these Terms on behalf of the minor and assume full responsibility.

THIS IS A LEGALLY BINDING AGREEMENT. BY PROCEEDING WITH PURCHASE OR ENROLLMENT, YOU INDICATE YOUR ACCEPTANCE OF THESE TERMS.
